This notice supplements the Pelvital USA, Inc. Privacy Policy and applies to personal data defined as “consumer health data” subject to the Washington State My Health My Data Act (MHMDA) or other applicable state consumer health privacy law. Any capitalized terms used but not defined in this notice have the meanings given to them in the Privacy Policy.
This Consumer Health Data Privacy Policy supplements our general Privacy Policy.
In the event of a conflict between our Privacy Policy and the Consumer Health Data Privacy Policy, the Consumer Health Data Privacy Policy applies as to consumer health data to the extent that it is consistent with applicable US state law.
Consumer Health Data We Collect
Examples of consumer health data we collect may include:
- Information about your health-related conditions, symptoms, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other interventions). For example, we may collect such information through surveys or other communication with you for research studies and improving product accessibility. This may include personal information that you provide directly to us when you complete our questionnaires on the Site, self-assessment forms, verbally provided patient survey information, or electronic forms designed for you to self-report your physical health status on issues like incontinence and related diagnoses, medical history, symptoms, attitudes, and comorbidities.
- Measurements of bodily functions, vital signs, or characteristics to measure the effectiveness of the products and treatment.
- Payment data, for example, we may disclose your health data to our durable medical equipment distributors (DMEs).
- Geolocation information through the Site that could reasonably indicate your attempt to acquire or receive health services.
- Transactional data, such as information relating to or needed to complete your orders on or through the Services, including order numbers and transaction history with our business customers.
- Communications data based on our exchanges with you, including when you contact us to inquire about our Platform or for support from our experts for the Flyte® System, use the chat features, take our quizzes or interact with us on social media.
- Marketing data from the Site, such as your preferences for receiving our marketing communications and details about your engagement with them.
- User-generated content data, such as comments, questions, messages, and other content or information that you transmit, or otherwise make available on the Site, as well as associated metadata.
- Other information that may be used to infer or derive data related to the above or other health information.
Sources of Consumer Health Data
As described further in the Privacy Policy, we collect personal data (which may include consumer health data) directly from you, from your interactions with our products and services, and from third parties.
When you use our Site, we collect some information through certain tracking technologies that may be considered Consumer Health Data. For example:
- Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, network activity, and location data. Online activity data, such as pages or screens you viewed on our Site, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
- Communication interaction data such as your interactions with our email, or other communications – we may do this through use of tracking technologies, like cookies, and pixels.
Why We Collect and Use Consumer Health Data
We collect and use consumer health data as reasonably necessary to provide you with the products you have requested or authorized.
This may include delivering and operating the Site and Platform, products and their features, personalization of certain product features, ensuring the secure and reliable operation of Services, the products and the systems that support them, troubleshooting and improving the products, and other essential business operations that support the provision of the Site and Platform, products (such as analyzing our performance, meeting our legal obligations, developing our workforce, and conducting research and development).
Our Sharing of Consumer Health Data
We may share each of the categories of consumer health data described above for the purposes described in the How is User Information Disclosed? section of the Privacy Policy. In particular, we may share personal data, including consumer health data, with your consent or as reasonably necessary to complete any transaction or provide any product you have requested or authorized. And we may disclose data when we believe that doing so is necessary to comply with applicable law or respond to valid legal process, protecting our, your or others' rights, privacy, safety or property; auditing our internal processes for compliance with legal and contractual requirements or our internal policies; enforcing the terms and conditions that govern the Site and Platform; preventing, identifying, investigating and deterring fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
Third Parties With Which We Share Consumer Health Data
As necessary for the purposes described above, we share consumer health data with the following categories of third parties:
- Service providers. Vendors or agents (“processors”) working on our behalf may access consumer health data for the purposes described above. For example, companies we’ve hired to provide customer service support, process payments, or assist in protecting and securing our systems and services may need access to data to provide those functions.
- Licensed Durable Medical Equipment Distributors (DMEs). We disclose information with DMEs when we have a business associate agreement in place or the DMEs are a Covered Entity under HIPAA.
- Parties to a corporate transaction. We may disclose consumer health data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.
- Government agencies We disclose data to law enforcement or other government agencies when we believe doing so is necessary to comply with applicable law or respond to valid legal process.
- Other third parties. In certain circumstances, it may be necessary to provide data to other third parties, for example, to comply with the law or to protect our rights or those of our customers.
How to Exercise Your Rights
You may have certain rights with respect to consumer health data, including:
- Right to Know. The right to know if we are collecting, using, or disclosing your Consumer Health Data, to access your Consumer Health Data, or to receive a list of the categories of third parties with whom we have shared your Consumer Health Data.
- Right to Withdraw Consent. If we are processing your Consumer Health Data based upon consent, the right to withdraw that consent.
- Right to Delete. The right to request that we delete your Consumer Health Data.
You can request to exercise such rights by contacting us at privacy@pelvital.com. We will ask you for two pieces of personal information and attempt to match those to information that we maintain about you. If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial.

We reserve the right to modify this Consumer Health Data Privacy Policy at any time. We will notify you before making any changes to our privacy practices with respect to your Consumer Health Data by posting an updated notice on this page, and changing the “Last Updated” date.
